Section 7
Appointment of Arbitrator by Court
(1) A party may apply to the High Court for the appointment of an arbitrator in the following cases:-
(a) If an arbitrator cannot be appointed after following the procedure mentioned in the agreement.
(b) If nothing is mentioned in the contract regarding the appointment of an arbitrator.
(2) In the application given under sub-section (1), the names, surnames, hometowns, professions and areas of expertise of at least three persons who can be arbitrators must be disclosed and a copy of the agreement must also be submitted with such application.
(3) Upon receipt of the petition as per sub-section (1), the High Court shall give notice to all the parties, and if there is a consensus of all the parties concerned regarding the person to be the arbitrator, the person proposed by them and if there is no consensus, the High Court shall appoint the person as the arbitrator within sixty days of the receipt of such petition. . The decision of the High Court will be final.
